Privacy Policy
Effective Date: March 26, 2026 · Last Updated: March 26, 2026
Casority, Inc. ("we," "us," or "Casority") operates the Claimulator website and tools at claimulator.com. Casority is a technology company — not a law firm and not a lawyer referral service. This Privacy Policy explains how we collect, use, disclose, and protect your personal information.
1. Information We Collect
Information You Provide
When you use our case evaluation tool or contact forms, we may collect:
- Name
- Phone number
- Email address
- Details about your incident (injury type, date, severity, jurisdiction)
- Liability and fault information you describe
Information Collected Automatically
- IP address (hashed for deduplication — we do not store your raw IP)
- Browser type, device type, operating system
- Pages visited, time on site, referral source
- Analytics data via PostHog (privacy-focused analytics)
2. How We Use Your Information
- To provide your Case Intelligence Score, filing deadline, and estimated value range
- To generate your Case Intelligence Report using AI analysis
- To connect you with an attorney through an independent referral service, if you request it
- To send you a confirmation email when you request attorney connection
- To improve our scoring engine and user experience
- To detect and prevent fraud or abuse
3. How We Protect Your Information
Personal information (name, phone, email) is encrypted using AES-256-GCM before storage — the same encryption standard used by financial institutions and government agencies. Data is transmitted over TLS 1.2+. Despite these measures, no method of electronic transmission or storage is 100% secure, and we cannot guarantee absolute security.
4. Who We Share Your Information With
We may share your personal information with:
- Overture Law — an independent attorney referral service — only if you click "Connect with attorney" and request to be contacted. Participating attorneys may pay a fee to receive referrals.
- A participating attorney matched by the referral service — only if you request attorney connection. Once your information is shared with an attorney, that attorney's own privacy policy governs their use of your data.
- Service providers — including Vercel (hosting), Supabase (database), Sanity (content management), PostHog (analytics), and Resend (email delivery). These providers process data on our behalf under contractual obligations.
We do not sell your personal information to data brokers, advertisers, or marketing companies.
5. Data Retention
We retain your personal information for up to 3 years from the date of collection, or until you request deletion, whichever comes first. Anonymized and aggregated data (which cannot identify you) may be retained indefinitely to improve our scoring models.
6. Your Rights
All Users
- Request access to the personal information we hold about you
- Request correction of inaccurate information
- Request deletion of your personal information
- Withdraw consent for communications at any time
California Residents (CCPA/CPRA)
If you are a California resident, you have additional rights under the California Consumer Privacy Act:
- Right to Know: You may request the categories and specific pieces of personal information we've collected about you.
- Right to Delete: You may request that we delete the personal information we collected from you.
- Right to Opt-Out of Sale/Sharing: See Section 7 below.
- Right to Non-Discrimination: We will not discriminate against you for exercising your privacy rights.
- Right to Limit Use of Sensitive PI: Information about your injuries may be considered sensitive personal information. You may request that we limit our use of this information to what is necessary to provide the service.
Residents of Virginia, Colorado, Connecticut, and Other States with Privacy Laws
You may have similar rights under your state's privacy law, including the right to access, delete, and opt out of targeted advertising. To exercise any of these rights, contact us at the address below.
7. Do Not Sell or Share My Personal Information
When you request to connect with an attorney, we share your information with Overture Law, which may transfer it to a participating attorney. Under the CCPA, this transfer may be considered a "sale" or "sharing" of personal information because Casority may receive compensation in connection with referrals.
To opt out of this transfer: Email privacy@claimulator.com with the subject line "Do Not Sell My Personal Information." We will process your request within 15 business days. Note that opting out means we will not be able to connect you with an attorney through our referral service.
8. Telephone Consumer Protection Act (TCPA)
If you provide your phone number and consent to receive calls or texts, you may receive communications from Casority, Inc. (operating as Claimulator) and, if you request attorney connection, from a single participating attorney matched by Overture Law. You may revoke your consent at any time by replying STOP to any text message or emailing privacy@claimulator.com.
9. Cookies and Tracking
We use PostHog for privacy-focused analytics. PostHog collects anonymized usage data to help us understand how the tool is used. We do not use third-party advertising cookies. We do not participate in cross-site advertising networks.
10. Children's Privacy
Claimulator is not intended for use by individuals under 18 years of age. We do not knowingly collect personal information from children. If you believe a child has provided us with personal information, please contact us immediately.
11. Changes to This Policy
We may update this Privacy Policy from time to time. When we do, we will revise the "Last Updated" date at the top of this page. We encourage you to review this page periodically.
