These Terms of Service ("Terms") govern your use of the Claimulator website and tools operated by Casority, Inc. ("Casority," "we," or "us"). By using Claimulator, you agree to these Terms.

1. Claimulator Is Not a Law Firm

Casority, Inc. is a technology company. Claimulator is an informational tool. It is not a lawyer, not a law firm, and does not provide legal advice or legal representation.

No attorney-client relationship is created by using this website or any tool on it. An attorney-client relationship is only formed when you sign a written retainer agreement with a licensed attorney.

The information on this site — including Case Intelligence Scores, estimated value ranges, filing deadlines, and jurisdiction-specific content — is for informational and educational purposes only. You should consult a licensed attorney in your jurisdiction before making any legal decisions.

2. AI and Accuracy Disclaimer

Claimulator uses artificial intelligence and statistical models to generate estimates. These estimates are based on historical data, publicly available information, and general legal trends. They do not account for the specific facts, circumstances, evidence, or legal theories applicable to your situation.

No estimate, score, or value range should be interpreted as a guarantee, prediction, or promise of any outcome or settlement amount. Actual case outcomes vary significantly based on factors this tool cannot evaluate. Past results referenced on this site do not guarantee future outcomes.

3. Attorney Referral Disclosure

If you request to connect with an attorney, your information will be shared with Overture Law, an independent attorney referral service. Overture Law is a separate entity from Casority, Inc.

• Participating attorneys may pay a fee to receive referrals.
• Casority, Inc. may receive compensation in connection with the referral process.
• Any attorney who contacts you is not obligated to accept your case.
• You are not obligated to retain any attorney referred to you.
• The referral service does not endorse or guarantee the quality of any attorney.

4. User Representations

By using Claimulator, you represent that:

• You are at least 18 years of age.
• The information you provide is truthful and accurate to the best of your knowledge.
• You are using this tool for your own personal evaluation, not for commercial purposes.
• You will not use this tool to submit false, fraudulent, or misleading information.

5. Consent to Communications

By submitting your information through this tool, you acknowledge that:

• Casority, Inc. may contact you by email regarding your case evaluation.
• If you provide your phone number and consent to calls/texts, Casority, Inc. (operating as Claimulator) may contact you at the number provided using automated dialing technology.
• If you request attorney connection, your information will be shared with Overture Law, which may connect you with a single participating attorney who may contact you.
• Consent to communications is not a condition of using this tool.
• You may revoke consent at any time by replying STOP to any text or emailing privacy@claimulator.com.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CASORITY, INC. SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM:

• Your use of or inability to use this website or tool;
• Any estimate, score, or information provided through this tool;
• Any referral to or interaction with an attorney;
• Any decision you make based on information from this tool;
• Unauthorized access to or alteration of your personal information.

This limitation applies regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise), even if we have been advised of the possibility of such damages.

7. Indemnification

You agree to indemnify and hold harmless Casority, Inc., its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorney fees) arising out of your use of Claimulator, your violation of these Terms, or your violation of any rights of a third party.

8. Intellectual Property

The Claimulator name, logo, scoring engine, content, and website design are the property of Casority, Inc. You may not reproduce, distribute, modify, or create derivative works without our written permission. Your use of this tool does not grant you any ownership rights in our intellectual property.

9. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any dispute arising from these Terms or your use of Claimulator shall be resolved by binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive your right to participate in a class action lawsuit or class-wide arbitration.

10. Modifications

Casority, Inc. may update these Terms at any time. When we do, we will revise the "Last Updated" date. Your continued use of Claimulator after changes are posted constitutes your acceptance of the revised Terms.

11. Termination

We reserve the right to suspend or terminate your access to Claimulator at any time, for any reason, without notice. Provisions that by their nature should survive termination (including limitation of liability, indemnification, and governing law) will survive.
